SELLER agrees to sell and BUYER agrees to buy based on the following conditions:

This puppy/dog is a purebred Toy or purebred Miniature Australian Shepherd.

"AWAY TO ME AUSSIES" is a registered Kennel name.
The first three words in the registered name of said puppy/dog must be : AWAY TO ME.

The SELLER will provide up to date health information to BUYER at time of transfer of puppy/dog along with registration application forms unless said puppy/dog is being sold as a pet. In which case Breeder/Seller will hold the registration papers until written proof of spay or neuter is provided from the Veterinarian.  All pet/companion puppies application for registration will have the "Not for breeding" box checked by the breeder. By signing this contract the BUYER accepts the agreement that any puppy designated as a pet/companion puppy will not be bred.

All puppies are temperament and quality evaluated between approximately 8-9 weeks and pet quality are sold on a spay/neuter contract.

Breeder/Seller does not guarantee size of puppy/dog to remain a Toy or grow to Miniature.

The Buyer shall maintain the puppy/dog in good condition, including adherence to a regular immunization schedule, heartworm prevention, good diet and clean and safe environment.

72 hour (3day) Health Guarantee:
SELLER guarantee's puppy/dog to be sound and free of diseases at time of transfer of said puppy/dog to BUYER for a period of (3) days. BUYER agrees to have said puppy examined by a licensed small animal veterinarian within (3) days of receipt of said puppy/dog. If said puppy/dog is found to be in poor health during this time period, as evidenced by a signed, written report by a licensed veterinarian, buyer will have the option to return the puppy at SELLERS expense for a full refund or replacement as soon as a comparable puppy/dog of equal value becomes available.  SELLER has the right to request a second opinion from a non-associated veterinarian within a reasonable distance of BUYERS home. To refund or replace will be the choice of the BUYER.  If BUYER decides to keep said puppy/dog they will assume all expenses involved with said dog’s/puppy’s care.

26 Month Health Guarantee:
Breeder/Seller guarantees said puppy/dog up to 26 months from the birth date of said puppy/dog for genetic health defects which will take puppy’s/dog’s life.
Upon receiving a written and signed statement from two licensed veterinarians from two different clinics Breeder/Seller agrees to replace said puppy/dog with a puppy/dog of equal value should said puppy/dog obtain one of the following Genetic Defects.
Breeder/Seller agrees to replace said puppy/dog with a puppy/dog of equal value within a 12 month time frame.  This 12 month time frame is to give Breeder/Seller adequate time for new litters to arrive.  This 26 month health guarantee to be void if puppy/dog has been used for the purpose of breeding.  This must be submitted with a written statement from two different licensed Veterinarian’s from two different clinics certifying that this disorder will take the puppy’s/dog’s life.
1. Failure to receive a passing rating on hips from the Orthopedic Foundation for Animals.
2. Failure to receive a normal reading from Canine Eye Registration Foundation.
3. Additional debilitating conditions due to genetic health problems must be discovered 26 months from birth of said puppy/dog.  They must be submitted by two different veterinarians at two different clinics certifying that said puppy/dog is suffering from one of the following: Thyroid, epilepsy, immune suppression.
At that time BUYER can either keep said dog/puppy and assume all medical expenses with a refund of half of purchase price from SELLER or return said dog/puppy at BUYERS expense for a replacement puppy of equal value.

SELLER makes no guarantees regarding accidental death, theft, or sickness due to lack of vaccinations, worming or lack of proper care. If puppy/dog dies it is automatically assumed death took place from lack of proper care unless death is proven to be due to genetics as stated above.


The SELLER reserves the right to first purchase option on any AWAY TO ME dog/puppy that said BUYER offers for sale.

SELLER reserves the right that in the event Breeder/Seller should decide to discontinue breeding Toy and Miniature Australian Shepherds this contract will become null and void.


SELLER reserves the right to refuse the sale of one of our dogs to anyone.
BUYER agrees that this contract is non-transferable.

Buyer will be picking up said puppy _____ Buyer would like said puppy shipped _____.

Shipping is $__________________, which includes airline ticket, crate, health certificate.
SELLER reserves the right to choose the airline. If you prefer to use a particular airline please let us know.  Airline shipping is dependent on temperatures at both departure and destination locations and all stops in between, two hours before scheduled departed time.

The said dog/puppy may be paid for by the following:
1. By cashier’s check or money order. This must be received at least 10 days prior to transfer of said puppy/dog to clear bank.
2. By account to account wire transfer. This can be done one day prior to transfer of said puppy/dog.   BUYER is to pay all services charges for wire transfer including service charge on SELLER”S account.
3.  By Cash.  If puppy is to be picked up by BUYER  this can be paid to SELLER at the time of transfer of said puppy/dog.



The BUYER has read and understands the foregoing and agrees that all parts of this contract are a binding agreement with the SELLER. If either the BUYER or SELLER takes legal action regarding this contract, action will be initiated in the county of the SELLER'S residence and legal fees and court costs shall be the responsibility of the party found at fault.
